“The resolution stems from a recent incident where the judge allegdely insulted and misbehaved with a lawyer who has been practicing before the court for the last seventeen years”.
While acting on the various complaints received from its members regarding the disrespect meted out to them in the court of justice HARMINDER SINGH MADAAN, the Punjab & Haryana High court bar association has resolved to abstain from appearing the judge.
The resolution stems from a recent incident where justice madaan allegdely insulted and misbehaved with advocate parminder singh sekhon, a criminal lawyer practising before the court for the last seventeen years.
Nothing that the bar and the bench are two sides of same coin, the resolution states,
“Mutual respect between bar and bench is fundamental to maintenance of cordial relations. Any kind of insult or use of coercive language and snubbing attitude of the hon’ble members of the bench is unacceptable and against the constitutional scheme of things based on the maxim “absit iniuria verbis” and “absit invidia”.”
The bar association clarifies that it had requested the judge in question to treat the members of the bar on the principles of equality which is sine-qua-non for maintaining the dignity of the bar members, has unanimously decided to boycott the court of justice madaan.
It was further resolved that discipliniary action shall be initiated against any member who goes against the association’s decision.
