Following India’s Outstanding Success At The Tokyo Olympics, The Allahabad High Court Has Asked The Institution To Explore Including A Sports Quota In The LLM Programme

In the wake of India’s “outstanding” performance at the Tokyo Olympics 2020, the Allahabad High Court has instructed the Registrar of Deen Dayal Upadhyay Gorakhpur University to make a decision on providing sports quota for LL.M courses.

Juhi Dubey, a University and State-level cricketer who received a sports quota for her previous LL.B. course, which she completed successfully in the year 2020, filed the case.
She went to court claiming that there was no such quota for admission to Deen Dayal Upadhayay Gorakhpur University’s LL.M. (Post Graduate Course).

Justice Saurabh Shyam Shamshery, a single-judge, issued the ruling in response to a petition brought by a law graduate who had addressed the Court, noting the lack of a “sports quota” in the University’s LL.M programme.

“The writ petition is disposed of with a direction to the Registrar, Deen Dayal Upadhyay Gorakhpur University, Gorakhpur, that in order to provide more support to such sports persons, the University will take a decision, in the interest of sports persons, considering that sports persons of this country are doing very well even on an international level, to provide sports quota for LL.M. Course as well,” the court mentioned.

The Court stated that the University should provide such bright athletes with the benefit of the sports quota even in postgraduate courses.

“Also, state and federal governments are assisting aspiring athletes, and we hope that our country will win more medals, prizes, and trophies in upcoming international sporting events, such as Cricket,” the Court stated.

The University’s counsel, Advocate Rohit Pandey, stated that sports quota is supplied faculty-by-faculty, and that the whole quota of two seats is for the LL.B. Course, with no quota available for the LL.M. Course.

“However, it is undeniable that an acceptable decision about sports quota in LL.M. Courses can be made at the university level,” he noted. As a result, the University Administration was asked to make a decision on whether or not to provide a sports quota for Post Graduate students (LL.M).
