Supreme Court Stays Madhya Pradesh High Court’s Order To Constitute Special Commissions To Conduct Inspection At Nursing Colleges

Supreme Court on Friday (September 17) stayed Madhya Pradesh High Court’s arrange for review of Nursing Colleges being run in Gwalior, Shivpuri, Sheopur, Morena, Bhind and Datia locale by designating Commissions comprising Legal counsellors, District Judge and Collector of District.

 Challenging the High Court’s arrange, the Affiliation had contended that the High Court was not redress in issuing bearings for review of Nursing Colleges by individuals from Non-Medical areas such as Legal counsellors, District Judges and Collectors.

The Petitioners further fought that, the State Government had made “Madhya Pradesh Nursing Shikshan Sansthan Manyata Niyam, 2018” and the control of assessment had been given to the Madhya Pradesh Nurses Registration Council.

 “Whenever the Board and University conducted the review once a year, it was done by individuals from the restorative field comprising one Senior Specialist from Government Therapeutic College and one Principal from Government Nursing College,” applicant expressed in their SLP to fight that there was a statutory body for assessment and the bearings for inspection by some other body could only be issued by Indian Nursing Council.

Madhya Pradesh Nurses Registration Council & Ors. detailed in (2019) 5 SCC 379 in which assessment of Nursing College was done by the specialized body, i.e, Madhya Pradesh Nurses Registration Council.

 “Most of the Nursing Colleges are running for a period of 20 years and the review is done each year by the Madhya Pradesh Nurses Registration Council and University too. That indeed recognition of the Nursing College is done by the Madhya Pradesh Nurses Registration Council as per Run the show 5 of the Madhya Pradesh Nursing Shikshan Sansthan Manyata Niyam, 2018 and indeed cancellation of acknowledgment beneath Rule 8 is by the Madhya Pradesh Nurses Registration Council,” petition stated.
