Former governor of Uttar Pradesh Dr. Aziz Qureshi had been booked for the crime of sedition under section 124A. He has been granted protection from arrest by the Allahbad High Court on Friday i.e. 1st October, 2021. As reported by his consel senior Advocate Salman Khurshid, Qureshi, who was booked because of making alleged derogatory and harmful remarks against the Chief Minister of Uttar Pradesh Yogi Adityanath, has been granted protection as the court cited his age and the fact that he is a former Governor.
An FIR was filed against him last month on the complaint of Bhartiya Janta Party (BJP) leader Akash Kumar Saxena. The order of protection from arrest was given by a bench comprising Justice P. Diwaker and Justice Mohd. Aslam. Saxena had claimed in his complaint that Qureshi had made such derogatory statements against the state government that are capable of creating serious tension between two communities and could create unrest in the society. Dr. Aziz Qureshi was booked under multiple sections of the Indian Penal Code including 153A (promoting enmity between two groups on grounds of religion, race), 153B (imputations, assertions prejudicial to national integration), 124A (Sedition) and 505(1)(B) (intent to cause fear or alarm to the public). Notably, the number of cases filed under the article 124A have been skyrocketing since the past few years and there are substantial discussions going on for declaring the section unconstitutional as it unreasonably hampers the fundamental right of freedom of speech of citizens.
