Delhi High Court has directed city police not to harass the owners of hotels and restaurants for their serving herbal hukkas . However the court the random checks based on complaints and grievances . The direction came out of the petitioner stand that they will serve the hookas in open space with disposable pipes .
Justice Rekha Palli asked the government to relook its decision of prohibiting all hooka bars within next 5 days .
On previous hearing court directed dept. of health and family welfare , Delhi to reconsider the matter in view and also the latest order made by delhi disaster management authority .
On 14th October Delhi government reiterated that prohibition on use of hooka with or without tobacco will continue to be in force in all bars and restaurants .
Petitioner on other hand contended that they will use herbal flavoured hookas in open spaces with disposable pipes . It will not be shared and be used individually .
Petitioner argued that police intentionally park their vehicles before entrance gate , which obstructs the customers to go in freely without hesitation .
To which respondent ensured that no police will park vehicle in front of hotel to unnecessarily harass until next date unless some contingency .
According to DDMA , since smokers may be carrier of covid -19 and it can trigger to spread of the virus . Under Epidemic Disaster Act , 1897 , use of hookas in public places is strictly prohibited with immediate effect .
The court earlier asked the DMA to resolve the issue and allow the petitioner .
