Justice Hima Kolhi offered to disqualify herself from a case involving the continuing dispute between Future Group and Amazon since she and her family had interests in Reliance Industries Ltd.
Justice Kohli told the lawyers in the case that if anyone had a problem with her hearing the case, she would disqualify herself immediately.
The Chief Justice of India, NV Ramana, who presided over the Bench, informed the lawyers that Justice Kohli owns shares in Reliance, and that Reliance may be the ultimate benefactor of the action, therefore if anyone objects, she will withdraw herself.
The lawyers, on the other hand, stated that they had no objections to Justice Kohli hearing the case.
The CJI then requested that the same be noted in the order.
Future Coupons Private Ltd and Future Retail Ltd filed two special leave petitions against the order of the single bench of the Delhi High Court that directed the attachment of assets of Future group companies and its promoters Kishore Biyani and others for breach of the Emergency Award.
The Supreme Court had previously delayed the proceedings initiated by global e-commerce giant Amazon for the implementation of an Emergency Award issued in its favour by a Singapore-based arbitrator, which had blocked the merger deal between Future Retail Limited and Reliance Group, on September 9th.
