Civil Courts Cannot Declare Orders Passed Under Urban Land Ceiling Act As Illegal Or Non Est : Supreme Court

Supreme Court on Tuesday said that civil courts have no jurisdiction or exercise of power over subject matter of Ceiling proceedings , Urban land ( regulation and ceiling ) Act , 1976 .

Civil Courts can’t declare any order passed by the ULC authority as illegal or non-est .

The matter came in as the plaintiff filed a suit in city civil court , where possession of land is not taken under the Urban Land Act , 1976, And the Act repealed in year 1999 . The suit was decreed by the trial court , the second appeal filed dismissed against trial court judgement .

The apex court observed that the land in question is covered in urban agglomeration as per ULC Act , and land here is not only taken but also used for the  public purpose .

The court also said that the ULC Act , 1976 is a self contained act , is subject to appeal but to designated authorities for that matter , civil court are excluded to entertain these matters and barred to state the decisions of it’s authorities as illegal and Non- Est .
